Terms of Service

These terms of service herein govern individual or organizations use of the Accessible Events Platform (AEP) and any violation of any individual term shall constitute violation of these terms and may serve as grounds for termination of service as described in term 15 below.

Summary

The following is a very short bullet list that provides a vague but simplified version of the actual terms that follow:

Introduction

(1) The Accessible Events Platform (AEP) as developed and offered by Bridgeman Accessible is a digital platform/app/website that assists or augments individuals or organizations to endeavor to plan more accessible events through tooling that helps think critically about how accessible their events have been and will be and tooling that assists/augments event planners and holders in a way that results in more accessible events.

(2) By setting up and using your AEP account and using the system you agree to these terms in their entirety and any subsequent version of these terms which may change or be updated at the sole discretion of Bridgeman Accessible with no notice to users. It is the users responsibility to familiarize themselves with these terms and stay in compliance with them at all times.

User Account

(3) It is required that to be able to use the AEP that you create or have a Bridgeman Accessible account with an associated subscription. Individuals or organizations can create or manage their Bridgeman Accessible accounts by visiting the Bridgeman Accessible Accounts Dashboard (https://account.bridgemanaccessible.ca).

(4) An individual or organizations AEP account is directly tied to their Bridgeman Accessible account and any and all terms applicable for the use of that account also apply to their AEP account

Use of Service

(5) Individuals or organizations are permitted to use the AEP for event planning or other events related needs in the pursuit of more accessible events.

(6) Any kind of illegal, fraudulent, dishonest, misleading or otherwise potentially harmful uses are strictly prohibited. For the purposes of these terms we define a harmful use as any kind of usage that MAY or DOES lead to or cause harm to others, other users or the integrity of the service. This can include but isn't limited to actions that impugn or seek to degrade an individual or organization, actions taken to gain unauthorized access to an event's information or user, actions taken to impair the level of service that can be offered through the AEP such as a DDoS attack or similar. Any individual or organization found engaging in any such behavior will be found in violation of these terms which can mean the immediate termination of their usage and any associated pieces. Individuals or organizations may also, as applicable, be reported to local authorities for further legal recourse.

Accessibility Commitment

(7) While it is our goal to lead by example by providing a platform and set of tools that are as accessible to everyone as possible. Including attempting to be compliant with modern technical standards such as EN 301 549 and WCAG AA. It's possible that resource and other limitations and constraints may prevent or hinder our ability to achieve such a desired level of accessibility.

(8) We welcome user feedback, ideas or contributions particularly pertaining to the accessibility of AEP. To submit feedback individuals can email info@bridgrmanaccessible.ca.

Intellectual Property

(9) Ownership of any event related material or uploaded documents for the purpose of event planning or improving the accessibility of an event is retained by the user. However, In the event of a termination, all materials on the platform at time of termination are considered licenced to Bridgeman Accessible for the sole purpose of maintaining continuity if it so chooses. Any templates, designs, or other resources provided to an individual or organization.through the platform are the sole property of Bridgeman Accessible and may only be used for the purpose in which their prescribed when presented.

(10) We may choose from time to time to feature certain publically visible content for our own purposes including but not limited to investor or marketing materials. If you choose to make your material publically available through AEP you agree and/or licence Bridgeman Accessible to be able to use your materials in this way with no further notice or communications.

User Privacy and Data Protection

(11) In accordance with the Bridgeman Accessible Privacy Policy we only collect and use personal data or data that can be attributed to a singular individual in ways that we explicitly prescribe at time of collection.

(12) At Bridgeman Accessible we endeavor to offer our users and stakeholders information and data with the utmost care including attempting to implement modern security practices and leveraging offerings of our infrastructure partners/suppliers.

Liability and Warranty

(13) Bridgeman Accessible is not liable for any perceived or actual damage that may occur as a result of using our platform. AEP is provided as a tool or resource and DOES NOT guarantee better, more successful or more accessible events. Individuals or organizations take sole responsibility for their own event or success metrics and are responsible for ensuring compliance with applicable laws, regulations or standards.

(14) AEP is provided AS IS without warranty or guaranteed level of service. AEP may be unavailable or subject to maintenance outages from time to time at the sole discretion of Bridgeman Accessible without notice or communications.

Termination

(15) AEP usage and accounts may be terminated by Bridgeman Accessible at it's sole discretion without notice or communications and without recourse. These terminations will largely be for breaches of ANY of these terms but may, from time to time, be for other strongly compelling reason(s) at the discretion of Bridgeman Accessible.

(16) Termination of an account MAY include the deletion of the user, events and feedback records and any other uploaded materials. Though in accordance with term 9 above in which users licence Bridgeman Accessible accordingly upon termination Bridgeman Accessible may also choose to keep this material for continuity purposes.

Dispute Resolution

(17) These Terms of Service are governed by the laws of the Province of Manitoba and Canada.

(18) All disputes are to be resolved using binding arbitration.

Changes to Terms

(19) These terms may be updated by Bridgeman Accessible at any time and without notice.
